Welcome to Brickate. These Terms of Service ("Terms") govern your access to and use of the Brickate platform, including our website (brickate.org), the bkclient, bkserver, bkinstaller, and any related services (collectively, the "Platform").
By using Brickate, you agree to be bound by these Terms. If you do not agree, do not use the Platform.
1. Eligibility
- Age Requirement: You must be at least 13 years of age to create an account or use the Platform.
- Account Responsibility: You are responsible for maintaining the security of your account and password. Brickate cannot and will not be liable for any loss or damage from your failure to comply with this security obligation.
2. Software License & Restrictions
Brickate grants you a personal, non-exclusive, non-transferable license to use bkclient, bkserver, and bkinstaller for the purpose of playing and hosting games on the Platform.
Strict Prohibitions: You agree that you will not, and will not attempt to:
- Reverse Engineer: Decompile, disassemble, or reverse engineer any part of the Brickate engine, client, or server software.
- Cheating & Exploits: Use, develop, or distribute hacks, exploits, or third-party software designed to modify the core Platform experience or gain an unauthorized advantage.
- Unauthorized Distribution: Redistribute our installation tools (
bkinstaller) on third-party sites without written consent.
3. User-Hosted Servers & Networking
Brickate allows users to host their own game servers using bkserver.
- Networking Choice: Users may host servers via local hosting, port forwarding, or third-party tunnel services (e.g., playit.gg).
- User Responsibility: If you choose to share your personal IP address or a tunnel URL to allow others to join your server, you do so at your own risk.
- No Liability: Brickate is not responsible for the security, uptime, or content of user-hosted servers. We do not monitor private connections and are not liable for any data loss, network attacks (such as DDoS), or issues resulting from your hosting configuration.
4. Content & Intellectual Property
- User Creations: You retain ownership of the games you create. However, by uploading a game or thumbnail to
brickate.org, you grant Brickate a worldwide, royalty-free license to host, display, and promote that content for the operation of the Platform.
- Platform Rights: All Brickate branding, engine code, UI, and the "Bricks" currency system are the exclusive property of Brickate.
5. Virtual Currency ("Bricks")
- Nature of Bricks: "Bricks" are a virtual currency used solely within the Platform for cosmetics and store items.
- No Monetary Value: Bricks have no real-world value and cannot be exchanged for "real-world" money or legal tender.
- WIP Notice: As Brickate is a Work-In-Progress (WIP), virtual items, balances, and statistics may be subject to resets or changes during testing phases. While we strive to preserve balances, Brickate is not liable for loss of virtual items due to technical bugs or platform updates.
6. Payments & Non-Refundable Policy
- Final Sale: All purchases of "Bricks" or other virtual goods are final and non-refundable, except where required by law. By completing a purchase, you acknowledge that you will not receive money back for Bricks once they have been credited to your account.
- No Refunds for Bans: If your account is terminated or suspended for violating these Terms, you will not be entitled to a refund for any unused Bricks or virtual items.
- Parental Consent: If you are under the age of 18, you must have permission from a parent or legal guardian to make any purchases on the Platform.
7. Code of Conduct
While creators may set their own rules within their individual games, all users must follow these global rules on the Platform:
- No harassment, hate speech, or illegal activity.
- No attempts to crash, "DDoS," or interfere with the website or other users' servers.
- No impersonation of Brickate staff or developers.
8. Termination
We reserve the right to suspend or terminate your account at our sole discretion, without notice, for:
- Violation of these Terms.
- Engagement in hacking, exploiting, or malicious behavior.
- Creating a security risk for the Platform or other users.
9. Disclaimer of Warranties
Brickate is provided "AS IS." Because the platform is currently a Work-In-Progress (WIP), we do not guarantee that the service will be uninterrupted, error-free, or that your data (including "Bricks" or game progress) will be permanently preserved.
10. Changes to These Terms
We may modify these Terms at any time. If we make significant changes, we will notify the community via our official Discord server. Your continued use of the Platform after such notice constitutes your acceptance of the updated Terms.
